I want to say something about the concept of “Rule of Law”. I wrote a few words about it this week but I didn’t have time to respond to the questions I was asked, so maybe I will do it now The subject of Rule of Law There is a concept called Rule by Law The Rule of Law It is a negative concept, in the US, for example There is a famous American philosopher by the name of Emerson who said in English Translation: Good men must not obey the law too well. What is he proposing? Anarchy? What is there a law for? To break it? No, no, no, no We honor the law. We are not anarchists. We understand the importance of the law. “Without the fear of the kingdom, people would eat each other up alive” There has to be law and there has to be obedience to the law This has tremendous importance. Without it, there is no state, no sovereignty, nothing. That is clear. But it is absolutely forbidden to turn everything around and to exchange the essence for the tool. When the very obedience to the law turns into the essence When the State becomes not a tool for values that are beyond it, but instead, it is the goal The State is above all The law is above all That is really the same thing. Those are two sides of the same coin. That is fascism That is fascism. We must understand. We honor the law. We honor the law because of the values that it serves Not as essence in and of itself We do not exchange the reason for the outcome. So Emerson says to us, “Obey the law but remain a human being.” Remain a human being. Don’t say, “I don’t care, I will disconnect my conscience, I will detach my values I will disconnect my human image I will disconnect my human advantage and there is law and…that is fascism. That is an important point. In 99% of the cases, we must obey the law, but always remember that there is that point at which it is forbidden to obey the law and that is precisely the point at which you will be judged. Are you a human being? Or are you simply a fascist? Who doesn’t reach the stature of a human being. That is all for the topic of Rule of Law But I did want to add that when I saw the rightist protest in Zion Square in Jerusalem Signs that said, “Not Right, not Left, Rule of the Law. We are in favor of Rule of the Law!” Not in favor of a rightist government, in favor of the Rule of Law. Chevreh, I really lost it when I saw that sign The Rule of Law is a despicable concept The Rule of Law is what destroyed Gush Katif for you, dear rightists What was the claim 15 years ago when Sharon came to destroy Gush Katif? It was impossible to say that it would bring peace, because there was no accord So how did they explain to us why we have to destroy Gush Katif? Why do the soldiers have to obey orders? What was the claim? If we don’t obey this horrific order to drive people out of their legal homes and to destroy them and their synagogues and dig and take them out of their graves and to leave complete destruction behind us What was the justification for this? If you don’t obey the order, the State will be destroyed There is an order and it must be obeyed for…for the requirement to obey orders. That is exactly what it was The Rule of Law It will come to you again, dear rightists it will come to you again, because of those signs that you raised for Rule of Law. Because you didn’t learn anything The Left understands it perfectly well If somebody thinks that when the Left will rule it will come to your demonstrations Yes, it will come to your demonstrations like it came to your demonstrations in Gush Katif That is how it will come to your demonstrations Stop deluding yourselves and trying to look good Netanyahu has to go, yes. But don’t think that you will find the solutions in the province of the Left.
